CONSIGNMENT POLICIES:All Items consigned are sold without reserve, to the highest bidder
unless otherwise stated.
There are NO guaranteed prices on any item.
Indiana Law states that you may NOT bid on your own merchandise
without it being announced to all customers. If
you do bid on you own items, we will stop the auction and remove your
consignment. Auctioneer will negotiate on termination of the auction.
Auctioneer reserves the right to sell all goods according to
marketability of the goods and refuse to accept non-sellable goods.
Goods removed for any reason from the auction must be signed and
accounted for.
Lost checks are subject to charges. Stop payment fees are $32.00
Auctioneer will deduct the commission from the gross proceeds of the
sale of your items.
Items that do not sell must be removed by the consignor within 3 days
or they can be charged a disposal fee and proceeds check will be held.
Small items normally will be discarded by us.
In the event of non-payment by the buyer, Auctioneer, in his sole
discretion may (a) offer Property at a future auction, (b) cancel the
sale and return the Property to Owner. Auctioneer shall not, under any
circumstances, be liable for any consequential damages to Owner as a
result of non-payment by the buyer.
If seller packs goods, Auctioneer is not liable for damages.
Auction Company has the right to charge a Buyers Premium, and that
belongs to the Auction Company.
Appraisals are not a guarantee of Auction Prices.
We, as Auctioneers, can not establish a value for sentimental
reasons, we can only sell at auction to the highest bidder.
Auctioneers do not warrant Safety or Working Conditions of anything
sold.
Any item removed by seller, prior to auction, is subject to our fair
market appraisal & double the commission.
Trash will not be hauled free. NO hazardous materials, NO illegal
items.
Any vehicle the auction company sells must have insurance and must
provide all documents.
Any check lost in the mail will need two (2) full weeks from the date
mailed to be returned to Smith Auction Services, LLC by the post office.
After such time, check will be reissued.
Signature on the consignment control form is a legal and binding
contract and agreement of our terms.
Indiana law states payment must be made within 30 days of the auction, however, Smith Auction
Services, LLC usually pays the following Tuesday after all the item(s)
have been sold.
We are an auction business and not a moving company by trade. Any moving
of goods other than to be sold at auction, Smith Auction Services, LLC
will not be liable for any damages on property.
All staff members and auctioneers employed by Smith Auction
Services, LLC are permitted to bid on their own behalf and purchase
items for their own use.
